Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the MyEMR platform, websites, mobile applications, and related services (collectively, the “Services”) provided by Advayan Technologies Pvt. Ltd. (“we”, “us”, “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

You must be at least 18 years old and legally authorised to enter into this agreement on behalf of your organisation. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorised access.

Access to the Services requires an active Subscription. Fees are billed as per the agreed plan and are non-refundable except where required by law. We may revise pricing with at least 30 days’ prior notice. Overdue payments may result in suspension of access after reasonable notice.

We process personal and patient data in accordance with our Privacy Policy and applicable law, including the IT Act 2000 and the DPDP Act 2023. The Customer remains the Data Fiduciary for patient data; we act as a Data Processor under the Customer’s instructions.

All rights, title, and interest in the Services — including software, design, trademarks, and documentation — remain the exclusive property of Advayan Technologies Pvt. Ltd. Your Subscription grants a limited, non-exclusive, non-transferable right to use the Services during the subscription term. Data you upload remains yours.

We strive to maintain high availability but do not guarantee uninterrupted access. Planned maintenance will be notified in advance where practicable. Support is provided per the terms of your Subscription. Service levels, if any, are defined in your order form or master service agreement.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Services shall not exceed the fees paid by the Customer in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, or consequential damages. Nothing limits liability that cannot be excluded under applicable law.

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your misuse of the Services, your violation of these Terms, or your infringement of any third-party rights.

Either party may terminate the Subscription per the agreed notice period. We may suspend or terminate access immediately for material breach of these Terms, non-payment, or unlawful use. Upon termination, you may export your data for a defined period, after which it is deleted per our retention policy.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka.

We may update these Terms from time to time. Material changes will be notified via email or an in-platform banner at least 30 days before taking effect. Continued use of the Services after changes take effect constitutes acceptance.
